families whose relatives and/or friends that were killed by opd and filing a suit against the city and police dept will not decrease the numbers of murder. felons and convicts that decide to further thier education and have decent jobs will decrease the numbers.

Let’s keep it real for a minute I don’t care who you are if you have 2 fatal shootings in a year of unarmed suspects you should be automatically fired from the force. I truly hope the attorney John Burris is successful in trying to get the Attorney general to prosecute, and equally successful with his civil lawsuit. Honestly does anybody have to guess what the outcome of the police investigation is going to be, come on people its called liability? I have yet to hear in any cases even the cases where police were prosecuted, the department come out and say outright that they believed the shootings were unjustified; that would automatically give away millions of dollars to the victims’ families, which is sad because you want to believe that the people on the right side of the law would do the right thing and not simply protect their own. Does anybody believe it’s a coincidence that the reason why he shot unarmed 20-year-old Andrew Moppin back in December 2007 is almost identical to the reason he gave for shooting unarmed 27-year-old Oakland father of two, Mack "Jody" Woodfox. “I saw him reaching for something in his waist band”, which upon further review doesn’t make any since, if you are unarmed then what are you reaching for, but rarely does anybody get that far in the analysis, that reason which is typically given is used to cast the most doubt on the situation, I mean what are they going to say “He was big and black (or Latino) and you know how they are”. Even the officer’s attorney Harry Stern says “The officer has no obligation to in effect turn the other cheek and let the bad guys get off the first shot; our hardworking officers aren't required to have X-ray vision or be mind readers”, which is interesting given that fact that Mr. Woodfox didn’t have a gun so what shot was he suppose to be getting off. Mr. Stern’s comments would suggest that officers have the right to shoot first and ask questions later as if this is the Wild West, it’s not and they don’t have that right. Defenders of the police will often say “police have to make split second decisions”, “police are under a tremendous amount of stress.” you know what too bad. I don’t have a problem with police officers making decision if they are right then they should be rewarded but if they make a mistake, even if it is an honest one then they should face penalties. Police officers are not drafted in this country, they volunteer, and they are very well compensated for their troubles considering that you don’t have to be well educated to join. There are people who wake up every day and do something positive for their community; they feed the homeless, visit the sick and shut- in, mentor at risk youth, advocate for ex-cons, even pick up garbage at the local parks and they do it all without the need and intimidation of a gun, at the end of the day police officers aren’t the hero’s society tries to make them out to be and if you don’t believe me just ask the children of Mr. Woodfox who must now grow up without a father all because of a mistake at best, hell if he would have been killed by a gang member at least people would talk about how much of a tragedy it is , instead of having his name dragged through the mud by the department.

WE LIVE UNDER A CONSTITUTION WHICH SAYS THE PPL ARE GOVERNED BY LAW, NOT MEN, AND THE LAWS ARE TO BE APPLIED EQUALLY TO ALL. THERE ARE TO MANY RECENT EXAMPLES OF ABUSE OF THIS PRINCIPAL. HOW DOES THE PERSON WHO IS DISADVANTAGED BY SOCIAL CLASS, LACK OF WEALTH, LACK OF EDUCATION & LACK OF UNDERSTANDING STAND UP AND SAY, "I AM EQUAL UNDER LAW"? WORST YET, AFFORD AN ATTORNEY. HE CANNOT. IT MUST BE DONE FOR HIM BY THOSE WHO UNDERSTAND, WHO HAVE TIME, AND WHO HAVE COMPASSION AND A STRONG SENSE OF JUSTICE.

SADLY, OFFICERS GET FULL PAY AFTER COMMITTING A MURDER THAT'S UNDER INVESTIGATION AND RARELY FACE CONSEQUENCES. I FEEL THIS IS WHY HUNDREDS OF ISSUES W/ POLICE BRUTALITY, FALSE ARREST AND MURDER EXIST IN OAKLAND. AS LONG AS THERE'S NO JUSTICE, THERE COULD NEVER BE PEACE B/C PEOPLE WILL CONTINUE TO FEAR OR HAVE NO RESPECT FOR THE POLICE. THEY CALL OAKLAND A DANGEROUS CITY FOR OFFICERS TO WORK IN, YET WE MAY READ ABOUT AN OFFICER GETTING SHOT EVERY 10, 20 YEARS..IF EVEN THAT, IN COMPARISION TO 7 TO 10 MURDERS THEY COMMIT YEARLY & NUMEROUS NON-FATAL SHOOTINGS. I DON'T CONSIDER THESE PEICES OF S*** POLICE OFFICERS. BUT TO THOSE WHO HAVE HAD UNACCEPTABLE EXPERIENCES W/ PARTICULAR ROGUE POLICE OFFICERS, JUSTICE DOESN'T ALWAYS COME BY WAY OF THE COURT ROOM B/C THIS ISN'T WHERE NONE OF US WILL SPEND ETERNITY. you people write too much.  The only people who care what you think are the other cop haters, criminal loving, ex-cons who read this drek.  But you already have them convinced, so you really don't have to try that hard.

Here's what will happen:  After a thorough investigation, it will be determined that the police officer did nothing criminally wrong in this shooting, he was after all, in fear for his life.  The bottom feeding attorney, John Burris will sue the city on behalf of the grieving family members and the City will settle for millions of dollars.

The same family members will buy an Escalade and some 40's and pour some out to their dead homie. And John Burris will get 40 percent.

Real talk.  I put that on everything I love.

I admit I can write alot being at x's I have alot to say about certain issues & very defensive when it comes to right from wrong. But fyi, not everyone in Oakland has had the wonderful opportunity of coming upclose & personal w/ the wrong side of OPD & other essential issues in the city, therefore I feel it's appropiate for some of us to exchange experiences, share & educate, which is the purpose of this forum. I've learned alot in here about city government & city officials from other ppl's postings (opinions) & I don't feel anyone over-expresses themselves or makes attempts to convince anyone. I just feel at times their trying to get their point across, nothing wrong w/ that. It's very interesting to me b/c I love my city which is why I care about what ppl in this forum from our community have to say. What is just as senseless as the ppl who commit unneccessary violence in our streets is the lonely extremist & fanatics who come to this particular Oakland (bay area)forum to more-often-than-not 'unneccessarily & unintelligently' vent, dissect & cap on other ppl's postings, relentlessly express animousity towards victims to violence, police brutality, & towards our youths in Oakland. Also, I don't have a limited mind-set which illogically judges a group of ppl, religion, race or city solely on the actions of a few. And I don't "hate" the unjustly or rogue cops. I pity them. By the grace of God, Oakland has been blessed to have good officers in the dept who have the courage to stand against many who slip thru the cracks & are rogue. They have a strong sense of justice, fairness, & compassion towards victims & family members. In every sense they are the definition of being a "decent human being". Matter of fact for some, it is these type of officers who have protected them from the hostile ones. To work in an enviroment like that is very stressful & they continously need our prayers.

That is really sad for you to write something like that.  In todays culture it does not matter how the youth choose to memorialize their lost love ones.  Wether someone is an ex con or not is irrelevent, all people have the potential to change.  Im sure you are not so squeaky clean.  He who lives in a glass house shouldn't throw stones

I just call it the way I see it.  You seem to be suggesting that pouring beer on a grave site is perfectly acceptable in today's culture.  To me its a waste of beer unless it happens to be malt liquor.  But still, with a few minutes I could come up with a more suitable offering. 

If it does not matter how the youth choose to memorialize their lost love (sic) ones, is there a difference between pouring beer on a grave and urinating on it.  You don't have to accept today's culture.  I clearly do not.  I reserve the right to comment on customs that don't resonate with me.  Until you came along and confirmed it I had only seen this custom of pouring beer on a grave once and it was in a television program.

You shouldn't have to be squeaky clean to have an opinion on  the subject of Law and Order.  Ex-cons should be treated like ex-cons.  When they have changed from being reprobates to morally principled fellow human beings I will treat them accordingly.   Until then I'd be foolish to leave my wallet or anything else I value out in the open.

Is that the tall glass bottle of malt liquor that the homies buy for pouring out on their gunned down brothers in the hood?

IMHO, Not a good choice if you want to drink and drive with your posse cuz the cops can tell exactly how much you've been drinking, you can't really hide that big a beverage when the cops pull you over and the glass bottles definitely leave a mark when they're used as a club toward the end of the night .

Eggbert is correct about the likely outcome of the lawsuit.  I wish Oakland would take a stand to fight these lawsuits by parasites, even if initially it costs more to fight them than settle.  Not only are these criminals' families causing a lot of city expenses because their family members are criminals, but they then expect to be paid by the city when those criminals get shot??  How dare they.  There was no discussion of the deceased's history, other than that he was 27 and a "father of two," but probably he was just another criminal deadbeat, driving erratically due to massive drug intake, and he got out and ran due to the poor judgment drugs will give a person.  His worthless girlfriend probably lied about what happened in order to build a case, because she is likely a criminal too, and may expect a cut of the proceeds.  I'm sure the officer had good cause to shoot and will be exonerated.  We need more proactive officers who intercept criminals and are not afraid to shoot when necessary.  The deceased would likely have killed someone if he had not been stopped first, that morning.

Wow, is it racist to tell it like it is, in Oakland? The guy driving all over the road in his deadly weapon, probably bought with drug money if it is a brand new car at his age and with his likely occupational history, who gets out and runs when finally stopped because he knows what else he's done and thinks they're going to get him for that, too, in his drug-addled state, is just a typical night in Oakland. How funny to call him a "father of two": the kids are likely illegitimate and on welfare, and their mothers live in subsidized housing, courtesy of you and me. There is not a dictionary in the children's home, and probably there are no books either, although there may be more than one TV. "Dad" rarely if ever sees the kids and is a huge negative influence on them by his mere existence. That is the story of Oakland too. The cops did not shoot a divorced father of two who happened to be out driving late at night with his fiance, minding his own business on his precious time off from his full-time job. You have to read between the lines a little and think of what is likely. That was quite remote. Only some black people think this is racist. The rest of us, including plenty of black people, know it is likely the truth.

Yes we do Live under a Constitution which says all that you mention and we are governed by Law, Not Men. Absolutely! THE LAWS ARE TO BE APPLIED EQUALLY TO ALL. That is all True. In the classroom, but apparently not on the streets of Oakland.

I know that you cannot take the principles put forth by the Founding Fathers and apply them to this situation. Do you think George Washington and John Adams, our first two Presidents wanted to extend courtesy and constitutional rights and everything in between to the British?

Look here's the deal, this is America, and in this country if you play by the rules you can rise in class, create wealth and be somebody. If you can't make it in America you won't make it anywhere.

You are living in a dream - you probably believe World Peace is possible if we just elect Obama, dismantle all our nuclear weapons and shutter the Pentagon. It's not going to happen. The way to achieve peace is to Destroy your Enemy. After you have destroyed your enemy you can enjoy peace.

I was responding to platitudes offered in a previous post.  If you'll re-read the post you responded to you will see the screenname of the person I was responding to. 

Your first statement is actually in perfect agreement with my main point.  In other words we are both in disagreement with the ideas expressed by the peacenik who appears above. 

I do know who the Enemy is - its the uninformed liberals, anarchists and atheists who have removed God from the public square.  And it's intellectual elitists who, somewhere along the line, have earned a law degree and bend their knees at the altar of the ACLU.  But this has little or nothing to do with a punk being executed for being Stupid in Public.

As the gentleman mentioned somewhere in an earlier post, when you resort to name calling it suggests that it is you who are verbally challenged.   To be arrogant means to be 'overly convinced of one's own importance'.  Am I arrogant because I don't agree with dimwits like you?  Or could it be that your own arrogance and inability to comprehend have left you terribly confused?

No Moses, you don't know who the enemy is. You have scapegoated me and others because of your own political biases and a lack of a clear and comprehensive political perspective. You've made all kinds of insults as substitutes for arguments including trying to pin all kinds of labels and create a false history about a person you know nothing about. The hatred of people like you and others on this site just does not extend to criminals on the street, it extends to all others who don't share your political beliefs and philosphy. There are a whole bunch of professional right wing talk show hosts on the radio, web and other places who churn out these hatred against those who have a deeper understanding of the political, economic and social forces moving our society than the glib, shallow and superficial analyses of crime as society's number one evil that you bring. You and others on this site mistake effect for cause. You have no knowledge whatsoever of the economic nor political structure/problems our society is facing today and try to impose a simplisitc moralistic-based law and order solutions to deeper societal problems. This has nothing to do with the ACLU. It has to do with a political and racist society philosphy that believes in an unequal form of justice where those who are poor and on the bottom of society deserve to be shot while those on the top creating equal or greater crimes that are equally disruptive to society go scott free. You have one tune and one solution to all of society's evils and problems today. Just bring in more cops, empower them to kill anyone who disobeys them regardless, and all of society's problems will be resolved in a nutshell. I'm not going to bother further debating you after you've hurled insults. You live in small little world and are oblivious to the larger economic and social crises that impact all of America at the local level. Suffice it to say, these problems will catch up with you and all the rest of the so-called virtuous law and order types. You can cheer the cops on, but when an earthquake comes along and shakes the bay area, it won't be the drunken drivers you will having to be worried about. There has been no real earthquake preparation in Oakland or anywhere else. An earthquake in Oakland and the Bay Area will cause devastation on an untold order that willmake all the chittering and chattering on this site come to a COMPLETE HALT. But government hasn't prepared for this eventuality although they've wasted billions in Iraq. This is no ACLU issue. This is an issue where Americans such as yourselves have not wanted to pull yourselves away from emotional self indulgence of wallowing in hatred to divert yourselves from the real problems facing our society today which underly Oakland's and other cities crime problems throughout the nation which are caused by more than Oakland's black welfare population.

Those who hate all liberals end up in a camp called criminal.  So Moses, when the day is done, you are no better than the street criminals.  Here's what a Unitarian minister wrote today about the sicko (who opened fire on Unitarians in their Church in Tennessee killing one and critically injuring 4  because he got cut off of foodstamps and blamed and hated liberals):  ":I've never heard of 'lbierals" taking up arms and shooting random people in public.  All too often I've heard of unhealthy persons espousing fundmanentalist values (yeah, removing the public god) wreaking just that kind of havoc.....I am ironicially proud that, indeed, Unitarian Universalists are such outspoken 'liberals' on issues like same-sex marriage, civil rights of all kinds and abortion rights that they caught the attention of a sick person out to get liberals.  I hope we never lose the belief that making a better world for all is our collective responsbility."  Another writer wrote about this killing:  "The context for these killings was set by Rush Limbaugh and his compatriots, by businesses that sponsor "hate radio," and by those who regularly listen to these programs. "  That includes you Moses.

IT is understandable that the POlice are scared.  Most people in this community are scared.  The fact that this officer is only 2 years out of the academy and has two fatal shootings in the past 7 months is very unsettling.  Just like everything.  The actions of few destroy the lives of many.  These Police need to not be so trigger happy.  This young man did not even run until after they started shooting him, that is one of the main reasons that I believe you will see justice in this young mans murder

So in your world there are no hereos and no villians I guess, except in reality, as you mentioned at the beginning of your post, there are hereos and villians, good guys & bad guys.  I'm fine with giving the police the role of hero since they do a job that most of us wouldn't want and since in many cases they are who you call to indeed, rescure you.  While the police are not without fault and there are indeed incidents of harrassment that occur, it's really damaging to place the blame of our degrading community on their failures to police with kind words and sweet kisses.  I don't know what city you live in, but Oakland has a problem with crime and blight.  I know you think everybody out there ruining the city just needs a big hug and nice new social program (that would go unused like the currently available outreach sources), but unfortunately somewhere along the line their FAMILIES failed to provide that and they grew up and became a problem in the community.  Its ridiculous, and frankly, shortsighted to continue to steer these types conversations away from personal responsibility (i'm sorry, I know those are bad words).  Why must society deal with these broken people after the fact?  What happened to the mothers, fathers, uncles, etc. who are supposed to take care of and guide their families?  Why doesn't Mr. Woodfox bear any responsibility for his choices he made in his life leading up to and on that night?  Do you know how impossible it is to be shot in the back if you aren't running away?  Not to say that I condone anyone being shot in the back be any means, but what would have happened had he simply stoppped his car and accepted his deserved ticket?  Presumably he would still be amongst the living and free to continue drinking and driving recklessly to his hearts content - until he possibly hit and killed some innocent driver.  At some point, at this point in history, excuses for pathology need not be the constant resting place of the black community.  Perhaps the black community needs to start policing their familes at home before the government does and accept and deal with personal choices made and the results of those choices.  And frankly, fathers that lead criminal lives are the ones responsible for having their children grow up without them - not the Oakland Police department nor the tax paying citizens of Oakland.

It's really bizarre to issue a threat to people on this comment site in response to discussions and arguments on whether or not Jimenez was justified in shooting.  Talk about incoherent!  We are not discussing what we should personally do when the police stop us here so you're comments are inappropriate and hostile  and hate-filled in the extreme.  You and others like you Moses  show that you are willing because of your hatred and hostility to shoot at people for all kinds of reasons and with very little justifications.  You prove, what the people of Oakland sense every day, that the Oakland police department has a bunch of characters in it that frankly ARE out of control and maintain hostile stances to the public and will threaten people for no reason and justification whatsoever.  Keep it up.  You're your own worse enemy.  It's you and people like you who give OPD a bad name and warrant the department being under federal monitors for a long long time.  They also warrant all the lawsuits. Loose lips sink ships and yours could use some botox.

Are you suggesting that Moses is an Oakland police officer?  What evidence do you have?  This only tells me that you use faulty assumptions to form your opinions.  Dangerous, very dangerous to do this because your entire house of cards will have been built on a shaky foundation.

That's the neat thing thing about these forums- it allows people to tell on themselves. One minute, when the topic is jovial or not so serious, people are giving out all kinds of info about themselves- letting you know their job position, income bracket, race, location, you name it- all to prove a point. But when the topic get heated they quickly forget this, and go off spouting hateful views as if they were completely anonymous, forgetting all info previously shared to earn credibility.   I have'nt really gotten much from this forum but in others I've witnessed cops, nurses, educators, all talking like hate mongering racists....Its a scary thing too because you can see what type of hateful individuals occupy which sectors of society's workforce, claiming to be good people who're racially indifferent, but are really just waiting for a forum in which they can express their true feelings.  Don't have a clue whether old moses is an Opd, don't especially care, I will say however it certainly would not suprise me...

Thank you alias.  We all know who the players all and they want it both ways.  First they post information on cases  online on the SF Chron site and start posting information that only OPD officers have access to and leaking us information to show their supposed "authority".  Then, when they cannot find any red meat there they come over to the Tribune site to start new games and bullying, insulting  and intimidation of posters.of  Then, when they don't succeed and end up getting  their hands slapped they cry foul.   These folks play all sorts of games including including posting  repeatedly under different usenames and play "good cop bad cop" on public forums pretending to be fair and unbiased.  They play every single game known and think that we are not wise to them.  They go around  trying to diminish and dehumanize anyone whose views aren't in accordance with their.  But every time, they end up tripping up themselves in their own arrogance because they think that nobody is on to them and their games.  Their actions are transparent and foolish in the extreme.  And, I won't even comment on their manners.   Then, they have the audacity to think they are going to instruct others, interrogate anonymous posters and that we are going to continue to engage in any kind of debate with them.  They need to go back to the nursery, all of them. If nothing else, take a long time out.

I probably would not have posted any of the hostile posts above if I were a POlice Officer. I believe it is quite possible for my identity to become known if someone suspected me of being in the OPD.

Let me just say the only time I hate cops is when they are writing me a ticket instead of a warning. Personally, there isn't enough money in copwork to justify my wearing the badge. I side with cops in general (but not bad cops).

Some of you whiny arrogant liberals don't give us credit for being against corruption in the local police force. My tactics in this forum are to explore the mindset of The Thief, someone who thinks they should be able to take something without paying for it, working for it, etc.

Try exploring the mindset of the capitalist, someone who thinks all actions can be justified by the the gain of a dollar regrdless of who must suffer down the line. Are the worldcom execs theives?...how about the mortage lenders who passd out all those neat little arm loans?....how about your republican commander in cheif who stole that election? You don't have to come here to find thieves, I'm sure your surrounded by them everyday , you just need to fine tune your perception a bit.

The killing was justified. Drunk drivers should be executed immediately as they are mass murderers. After the killing, a sanitation truck should be summoned, the body thrown in and taken to the nearest landfill and dumped in with the rest of the garbage.

Am I the only person annoyed by this rraa character!?! I am a person that agrees with both sides of the argument(as the story is written). If I truly felt my life was being threatened, I would do anything possible to protect myself and I'm sure everyone involved in this forums feels the same way. On the other side, with this officers history and seeing to the fact that this man was shot in the back, did he really feel that his life was in danger? And rraa police officers are clearly afraid of the criminals they face everyday because you never know the lengths they would go to--isn't that the cause of this article/forum, officer felt is life was in danger so he acted accordingly? Isn't this your arguement? I think everyone's points would be better understood if presented to the opposition in a receivable manner. Meaning, 1) speak(or type) in such a way that people can understand and not have cause to classify you as uneducated because at that point, the opposition feels that your comment is unfortunately, null in void and 2) respect the others involved in the forum and their opinions. To the eggberts, moses100s(whom I appreciate for pointing the out of control nature of our friend rraa), and the jifs(shout out to jif who I shared a great back and forth with about a month back), try to ease up on the name calling and attacks of character because those who you are attacking aren’t going to retain the root of your argument—that good stuff that would cause for a really good and intriguing debate. Type responsibly kids because I truly feel that almost everyone on here has something good to say! And enjoy the opinions of others whether they be the same as yours or drastically different because at the end of it all, I feel we can all learn from one another(excluding rraa ofcourse, psycho!) BLC09 - I accept your criticism of me (and thanks for the shout out otherwise) but I think that it is unfair to suggest rraa is a psycho.  Do not get me wrong, typing in all caps and railing and ranting drive me nuts too. (There is someone else who does that on this forum and it is equally as annoying.)  Am I the only person who thinks that rraa may be personally acquainted with Off. Jiminez?  Is it possible that rraa is seeing the strain and stress of this event destroying him and feeling helpless to relieve some of his pain.  FYI, I do not believe that police officers shoot and kill people and then sleep like babies afterwards.  Perhaps we could have as much sympathy for rraa as we do for anyone else who is watching someone suffer.  I realize that this requires us to view the police as human beings and not a bunch of automatons from whom we expect perfection.  Just a thought!

I do quite enjoy the suggestion in these forums that the police are the source of all the violence and murders in this city.  Oh how I wish there was a police blotter in the Trib so that we could read on a daily basis about all the violence that occurred the day prior (domestic violence, child abuse, robbery, rape, etc.) none of which is being committed by the police.  If you are of the opinion that this shooting was not appropriate, then by all means say so.  Do not make your argument null and void by blaming all of Oakland's violence on the police when this is simply untrue.  I am curious about one thing, why didn't Mr. Woodfox's family hire John Burris when Woodfox was charged with murder and all those other crimes?  Wasn't he worth the best defense then?  Or is he worth more to the family now?
